STANDARD TERMS AND CONDITIONS
Homegrown Timber (Rail) Limited Railway Safety Case operates on a midweek and
weekend basis. Midweek period being based on 10-hour shifts and Weekends based
on 12-hour shifts regardless of day or night.
Any shift that may start or finish on a bank holiday (excluding Christmas Day /
Boxing Day and New Years Day) will be subject to an additional uplift cost of
40% over and above the shift / hourly rate.
Any shift that starts or finishes on Christmas Day / Boxing Day or New Years Day
will be subject to an additional payment above the normal shift / hourly rate as
agreed between the client and Homegrown Timber (Rail) Limited.
Work under the Homegrown Timber (Rail) Limited (HTR) Railway Safety Case will
require that the following conditions be met:
- Site visit undertaken by HTR prior to works
- Work Package Plans /RIMINI Plans/ Risk Assessment / Lifting Plans produced by HTR to be read in conjunction with clients own Method Statement
- Each shift will have a Railway Safety Case Manager in attendance on site at all times
- All On Track Plant and attachments to be hired through HTR
- All Machine Controllers to be hired through HTR
All plant is hired under current CPA Model Conditions for the Hiring of Plant (with effect from July 2001) and the following conditions apply to our quote:
- All plant standing time shall be charged at two thirds of the hire rate
- HTR will not be held liable for any costs relating to direct loss or consequential delays arising
- HTR will not deviate from the Work Package Plan/method statement and reserve the right to refuse to undertake any work that is deemed unsafe or liable to affect the safe running of the railway. We have the right to close down the site until either the problems have been addressed or the client takes full responsibility for the cause of the shutdown
- HTR will not be held liable for restricted or lost access when third party provides access. Any abortive cost incurred will be for the clients account
- HTR will not be liable for third party attendance. Any abortive costs incurred through non-attendance of a third party will be for the clients account
Cancellation following a request for resources in connection with the above-mentioned quotation will be subject to the following charges:
- 0 - 48 hours prior to start of work - 100% of booked resource charge
- 2 - 7 days prior to start of work - 50% of booked resource charge
- Where resources can be allocated elsewhere without additional charges incurred then no charges will be charged to the client.
Where Sunday Night Shifts extend due to emergencies and the like, we reserve
the right to charge for downtime on Monday.
Our quotations are open for a period of 60 days from the date of each individual
quotation. We look forward to receiving instructs before the commencement of
work.
It is the responsibility of the client to ensure that the plant access / egress
is an authorised access point and that it is suitable to access / egress the
plant.
